Due to the low status of the system, the behavior of migrant workers' rights struggle is often more intense than other groups. Especially in recent years, because the way through resorting to legal and institution and other institutional rights end up with noting,a large number of non-institutionalized rights protections, such as suicide threats, strikes, smashing, become their important choice to protect their damaged interests. At the same time, the intergenerational differentiation of migrant workers is becoming more and more obvious. When the movement that new generation of migrant workers is the main activists is growing, the study of intergenerational differences on the non-institutionalized rights of migrant workers failed to cause the full attention of scholars. Although the researches about the non-institutionalized rights have been concerned, but scholars pay more attention to collective actions and lack intergenerational comparison. In addition, the researches about migrant workers on the non-institutionalized rights are less. In this paper, we focus on the intergenerational differences of migrant workers'non-institutionalized rights willingness, uses the theory of social resistance, bases on the questionnaire survey data of 1536 migrant workers in China, and use multiple regression and quantile regression methods to analysis the influencing factors of two generations of migrant worker's non-institutionalized rights willingness from the subject cognition, external resources and the opportunity structure to know the differences. Finally, based on the empirical research, put forward targeted policy advice to guide migrant workers take institutionalized rights protection. The study found that, first, compared with the older generation, the new generation of migrant workers' non-institutionalized rights willingness is higher; Secondly, in the multiple regression, the masses identity, fairness, political trust and personal vertical relationship have significant influences on the new generation of migrant workers'non-institutionalized rights willingness, and the factors that affect the non-institutionalized rights willingness of the old generation are construction industry, fairness, political trust, original achievement degree and union. In addition, from the different factors on the role of the two generations of migrant workers, first of all, the construction industry, trade unions, the goal of achieving have significant influences on the older generation of migrant workers, and the new generation has no similar effect.Secondly, the influence of the masses on the non-institutionalized rights willingness of the new generation of migrant workers is significant, but the effect on the older generation is not significant. Finally, fair perception and high government trust weak the two generations of migrant workers' non-institutionalized rights willingness. Thirdly, in the regression of the quantile, the identity and fairness of the masses have greater impact on the non-institutionalized rights willingness of the new generation of migrant workers, and the influences of the government trust, goal achievement and trade union are greater to the first generation of migrant workers non-institutionalized rights willingness. Therefore, based on the above conclusions, this paper argues that to guide the institutionalization of migrant workers, first, to enhance the credibility of the government, establish the image of the government, at the same time, strengthen the fair perception of migrant workers, give their true national treatment; Thirdly, to improve the life and welfare of migrant workers in the older generation, to promote the new generation of migrant workers to better integrate into the city, to achieve its development goals, in addition to give full play to party organizations' educational function is also possible. Finally, we must also strengthen the protection of migrant workers' rights and interest system to make them real use by the people.
