When representative system became generally accepted by most democratic countries, parliamentary democracy was also prosperity. People elect their representatives to parliament through the electoral procedures, so the parliament obtains the function of expressing public opinion and making laws. In order to protect the real public opinion and comply with separation of powers, it is essential to set a defense barrier to keep away from the illegal intervention and maintain the parliament independent. That is the reason why it parliamentary autonomy can exist. Although this right does not appear directly in the code, but its spirit is not only recognized by the constitutional countries, but also ensured by certain laws and systems. Parliamentary autonomy right usually includes the immunity of members of parliament and autonomy right of parliament rules according to the experience of some constitutional countries and some areas. However, in our country, we don't pay attention to this right and we don't even know what it is. This lead the national people's Congress and its Standing Committee are easy to suffer from undue interference so affects its independent status. This paper start with a fact which executive power interferes in Legislative power, then explain the origin of the parliamentary autonomy right and the theory and system basics. Furthermore, the paper introduces the experience of some constitutional countries and areas in order to compare with ourselves. Last, but not the least, the paper analyze the fact and the reasons of parliamentary autonomy in our country.
