The Applied Research On Psychological Test Technology In Criminal Litigation

The Psychological test (commonly known as lie detector) is as old as the history of the human subject. So far, human is still feel deeply troubled in this topic. They confused about both their own brain and mental activity and human values. Now, Psychological test techniques more and more use to the nations and regions. And the fields of application are further expanded; this method pushed human's confusion of psychological test to the extreme. Some people believe that psychological test is "a reflection of justice" and "savior of the innocent"; while others think that psychological test is essentially a "spirit of torture", and is against to the modern litigation values, especially focus on the protection of human rights in criminal proceedings.In China, the application of psychological test in our criminal procedure has caused widespread concern in society. In theory, scholars have been considerable differences about whether psychological test can be applied in the criminal investigation and whether psychological test as evidence can be in court. In practice, owing to our legislation doesn't have laws about psychological test, so different applications of psychological test in different judiciary. This chaotic situation is bad for the development of this technology. So, this article attempts to make some positive exploration on this subject.This paper introduces and analyzes the basics psychological test first, and then introduces the experience of psychological test in other countries; on this basic, combined with the application of psychological test in our criminal procedure, and build a set of psychological test system that suitable for China. The article consists of four main parts:The first part introduces the basic knowledge of psychological test, including the definition of psychological test, principles, the steps of implementation and its functions. The second part focuses on the application of psychological test in other countries, such as the History of psychological tests and their attitudes, the main pares are the counties which hold a positive attitude and a negative attitude to the psychological test. The third part is the key part, it is about the application of psychological test in our criminal procedure, analyzes the problems and the causes, and then to learn whether this technology in China is feasible. Four parts is also a focus, this part aimed at China's situation, and then establish a set of the application of psychological test system.
