Every coin has two sides, and cross-shareholdings are no exception. On the one hand,it has to reduce the risk of hostile takeover stability control rights to encourage enterprises to long-term operation, the promotion of investment diversification, and promote the state-owned shares of fragmentation and inhibition of shareholder dividend requirements, and enhance the company's accumulation ability of positive factors; on the other hand, there are also some negative factors, such as harm of company capital, violate the capital reality, affect the securities market transaction order, and maybe on the company's creditors and small shareholders'profit risk. The provisions of our law to its basic blank, even the latest version of the Company Law still no clear norms, the need for regulation of cross-shareholdings in order to better bring in economic development based on its pros and cons of analysis limits play a role. The purpose of this paper is not only a simple introduction of the cross-ownership, but hope that through the study of the legal nature and characteristics, so as to promote China's Company Law, Securities Law and other relevant laws of development and perfect company cross-ownership legal regulation of specific legislation and supporting system.
