On China's Rural Land Acquisition Compensation System Improvement

At the current stage,900million people in china belong to rural population, accounting for70percent of the country's total population of more than1.3billion. For the broad peasant masses, arable farming is a traditional basic way which they relies for survival. As the level of market economy in our country continue to increase and the scope of urbanization expand gradually, the speed of transition agricultural land to non-agricultural land is pacing up. Agricultural land, especially in the urban and rural connecting areas, is extensively requisitioned in the country, which is used for non-agricultural construction. An amendment to the Constitution of the People's Republic of China says that the state may requisition land with some compensation according to law on public interests. Although the system of compensations to requisitioned land is defined at the height of constitution, in reality requisition land by government become a key factor to influence the farmers'interests. Because the protection system of land requisition and the right of operation of agricultural land is imperfections, the principle of compensation is unclear, the standards for compensating is low and the ways of law aid is not open, the farmers' interests was deeply muted and ignored. Disputes, conflicts and petition caused by requisitioning land occurred regularly, which become a main problem that influencing social harmony.In our country agricultural land still carry the function social security, establishing and improving effective system of compensations to land is great significance for protecting the lawful rights of losing land farmers. This thesis is going to explore the improvement of the system of compensations to land at the aspects of the right of operation of agricultural land disputes of requisition land, law aid and so on.
