In this paper, taking empirical survey research methods, to understand the new features of juvenile delinquency and trends, the protection for the education of minors, prevention of juvenile delinquency is undoubtedly of great theoretical significance and practical value.This survey is to survey case files, the survey is to hear the situation of juvenile cases in 2005-2009 in a district people's court, select the district court is due to the grim situation of juvenile delinquency, the floating population, there cities and large rural areas with the characteristics of the task facing the reality of difficult minors control. The investigation is focused on the number of crimes, criminal subject's age and identity, type of crime and sentenced to penalties and other aspects. Through this research, propose prevention and control measures for the new era of juvenile delinquency, and some sound legal proposals in the hope of prevention of juvenile delinquency has a reference value.This article includes three parts, a total of about thirty thousand words.The first part is to present a whole overview of juvenile delinquency. First, from the current international concepts of different juvenile delinquency definition ,I put forward the concept of juvenile delinquency on our definition; Second, reviewing the situation of juvenile delinquency of recent several decades, and analyzing the current minor crime situation; Third, basing on the empirical survey data, the number of juvenile delinquency crime, the main characteristics, the type of crime and the penalties for the situation , knowing the total number of crimes have steadily dropped, but still remaining at a high level , the Court's decision reflects the case of minors policy of Penalty; Finally, understanding the great significance of prevention of juvenile delinquencyThe second part is to address measures of legislation for juvenile delinquency prevention and control. First, the sum of the current entity of juvenile delinquency law and procedures; Second, assessment current legislation, minors of the current legislation are provisions of the law of adults to deal with crime, there is no specific minors Criminal legislation in conducting to prevention of juvenile delinquency and crime, and the protection of minors; Finally, making some of juvenile delinquency prevention legislative proposals, the most important is the development of specialized juvenile law, including different rules and procedures and penalties with adult crime punishment, reflecting justice of the juvenile delinquency.The third part is the proposal to perfect the justice responses of juvenile delinquency. Including the process of dealing with juvenile delinquency cases, the investigation stage, the prosecution stage, trial stage and the four stages of the implementation phase of minors "special" justice responses.In the investigation stage, compulsory measures are strictly limited in depriving of liberty of minors ,to protect the legitimate rights and interests of minors; in the prosecution stage, defending the rights of minors need establishes special protection, and establishes the system of points charged; In the trial stage ,improving the juvenile court trial mode, and strengthening the court trial in the education of minors; in the implementation phase, establishing a minor correction of multiple agencies, attending the role of community corrections and non-discrimination policy of juvenile rehabilitation development.In the treatment of Juvenile Crime, we must establish the concept that juvenile delinquency is preventable and curable, but the prevention of juvenile delinquency is a systematic and long-term work, not overnight, we must rely on the whole community's common efforts to establish prevention of juvenile crime, social networks, to eliminate various negative factors, to help young people to achieve social success, to achieve the purposes of reduction and prevention of juvenile delinquency.
