At the end of2007, China had been Submitted the preliminary bids list of Appendix1to WTO secretariat. The preliminary bids list of Appendix1of China did not include state-owned enterprises,which contrary to the expectations of the EU and other members of the GPA. Whether state-owned enterprises should be included in the GPA jurisdiction,which is one of the most difficult problems of China's accession to the GPA negotiations that may be encountered. GPA text does not clearly define the government procurement entities which should be included in the jurisdiction. However, the "The government's control or influence" standard terms and "Bound entity control" principle in practice development can help China to provide guidance for the bidding and negotiation about the issues such as whether state-owned enterprises should be included in the GPA jurisdiction.There are five parts:First, introduction.Second, the basic legal Government procurement issues.Third, the research about the Government Procurement Law System of GPA members.Fourth, the enlightenment for Chinese state-owned enterprises about the measures of foreign countries to join the GPA. Fifth, conclusion.In the writing process, I am keenly aware of China's accession to the GPA is the irresistible trend. There are both opportunities and challenges for the state-owned enterprises. We must be ready to join, to take appropriate response measures.
