Government Procurement Law of the People’s Republic of China and the Governmentof the People’s Republic of China procurement implementation of the Ordinance do notinclude state-owned enterprises into the main areas of government procurement, and ourgovernment under international pressure submits the Government Procurement Agreement(GPA) quotation list in2010. The list does not include state-owned enterprises into otherprocurement entities category, which is not consistent with international practice. Chinashould try to be part of the state-owned enterprises first in the main within the scope ofChina’s political and legal procurement law, to regulate the material procurement ofstate-owned enterprises. This article first defines the concept of state-owned enterprisesand their legal status, and then analyzes the state-owned enterprises into China’sgovernment procurement system, the necessity and legitimacy of its procurement status, onthe basis of this study, explores its included in the scope of the government procurementsystem. The article by analyzing the list of countries to offer in the GPA, clears entities andexceptions of the opening of the national state-owned enterprises, and then explores thefield of state-owned enterprises which may be included in the list of China’s GPA offer.
