The Research On Environmental Protection Law Of Constructing The "Great Xi’an"

Based on the analysis of the environmental protection requirements, environment pollution situation, environmental protection situation for the construction of rule of law and the main Legal barriers in Xi’an area, this paper discusses that to strengthen and improve the legal system construction about environmental protection has significance.According to environmental protection requirements of the National Twelfth Five Year Plan, Guanzhong-Tianshui Economic Zone Development Plan and the Twelfth Five Year Plan of Xi’an, the task to construct "Great Xi’an" in the future is clear and arduous. Although the environment in Xi’an city in recent years has a degree of improvement, the environmental pollution problem is still arduous, the ecological system is still disturbed and damaged by human.The ecological environment is fragile, water resources is short, and the ecological problems are outstand. Except the natural geographical environment and urban expansion, the main reason is our country’s legislation, enforcement, supervision of the environmental protection laws system have other problems.Through the analysis of China’s environmental protection work, the paper finds some deep environmental problems,such as irrational industrial structure and economic growth mode still don’t get fundamental changes, and environmental protection lags behind economic development situation, and the law enforcement is lax, the regulation is slack. Especially the local environmental protection work which has extremely important function of environmental protection still has many problems to resolve.In view of the above discusses, combined with the Xi’an area characteristic, the article suggests that the government should strengthen regional environmental protection construction of the rule from environmental legislation, enforcement. Besides water, air, forest, mineral resources, wild animals, the protection work should also pay attention to the combination of the ancient city of Xi’an city characteristics and the future construction of the international metropolis special request to strengthen environmental protection law construction about the tourism environment, cultural buildings and the urban underground environment, the traffic environment protection and urban domestic waste treatment.
