Study On Quantitative Method Of Responsibility Determination And Casualty Compensation About Porduction Safety Accident

In recent years, disputes caused by disagreement with the result of responsibilitydetermination and unsatisfactory to the industrial injury definition, disability evaluation andcasualty compensation, have happened occasionally, which had a major negative effect onsociety. Consequently, it is important and necessary to do related research on responsibilitydetermination, calculation method of casualty compensation standard and optimization ofindustrial injury definition and disability evaluation work.According to the problems existing in the responsibility determination of production safetyaccident，this paper put forward a quantitative method of responsibility determination. And itestablished an accident factors set from safety management, safety technology and occupationalhealth and combined with the idea of expert grade method. Besides, through analyzing thepresent situation of casualty compensation, improvement proposals about industrial injurydefinition and disability evaluation were given. And a calculation method of accident casualtycompensation standard was proposed. Based on the consideration of casualty compensation foraccident prevention and according to the income loss theory, this calculation method increasedthe fines paid by enterprise due to the casualty accident. In the last, the feasibility of accidentcasualty compensation modes our country could take was analyzed.The study shows as follows: the quantitative method of responsibility determination reducesthe influence of subjective factor, which makes the responsibility determination more objectiveand fair; the improvement proposals about industrial injury definition and disability evaluationmay prompt compensation work to be more perfect; the calculation method of casualtycompensation standard fully considered the interests of the accident victims, which may promptenterprises to increase safety input to raise the safety level and reduce the accident rate; in theaspect of casualty compensation, our country should strengthen existing complementary modeand may try to adopt exempt mode.
