Ecological ethics generated and developed on the basis of the traditional ethics.traditional ethics involves the relationshipn between people,researching the ethical and moral concepts that human society should abide by,but lacking of concentrating on terelations between people and nature.With the progress of science and technology,and the rapid economic development, for resources obtained from the use of the environment has become increasingly frequently, human living environment has undergone enormous changes,and we can’t afford most of these changes, this will not only damage the interests of human beings, but also against the interests of all living creature. Through the ethical consideration of environmental problems,ethical ethics creats from it.Ethical ethics thinks that humans and nature is not simple subject and object,and not the relationship of use and utilization.Humans need to give the ecosystem moral concern and respect for the insterests of the survival of all creatures,in order to maintain the integrity and stability of the ecosystem,and to safeguard the sustainable development of human socity.Ethics is the connotation of legal,and legal is the support of ethics. Ecological ethics is a kind of ethics that contains all living creatures, which Regulate people’s environmental behavior in ethics ways.In the meanwhile,we need environmental legal strictly regulate such behavior in legal form.For now, the problem of environmental pollution in China is not optimistic, environmental law enacted in1989is slightly old fashioned and broad, which can not adapt to the current environmental questions, we need to remedy urgently.One of the most powerful methods is formulating and correcting a targeted and detailed administrative regulations, using legally binding measures to curb the deterioration of environmental pollution, and efficiently deal with the in-creasingly serious environmental problem.Pollution charging system in the country has had a history of30years,on July1,2003,"Sewage charges levied Use Management Ordinance"and the relevant regulations has come into effect.That ordinance aims at envi-ronmental issues in all aspects of the society as a whole.based on"the polluter pays principle",using The role of economic levers, mandatoring by virtue of the law, which has played a great role in punishing the sewerage behavior of polluters for damaging the environment.However, the problem of the poluttion charging system in China is long-standing, it utilizes the role of "economic leverage",but also with the the force of law. from the perspective of economic analysis,the most obvious problem of the Chinese pollution charging system is lower fee standard and less clauses; from the perspective of law analysis, the problem of the pollution charging system is that the lack of rigorous regulations set non-standard and administrative enforcement.From these terms, it seems that the pollution charging system as long as the content can be modified to improve the low status quo of pollution control effectiveness, but after several amendments to the charging system did not achieve the expected effectiveness, tracing the source, the problem is that the root cause of the lack of ecological ethics, the revision of the system is not the value of benchmarking.Pollution charging system, the establishment of the principle is that the polluter pay principle, resource theory of value and the external diseconomies theory, they both reflect the concept of ecological ethi-cs.especially the basis of "the polluter pay principle", elaborating the concept of returning the fair to the nature and societyjet groups or individuals who occupy the resources to balance the interests of ecological by economic compensation. So, adjusting the pollution charging system to adapt to the increasingly complex problem of env ironmental pollution,the fundamental solution is to establish the concept of ecological ethics,makeing the system content to comply with the requirements of ecological ethics, implementation of the system in line with the ecological ethics,the implementation of the system is under the social environment of ecological ethics. The basic structure of this paper is as follows.The first part discusses the connotation of ecological ethics, as well as its origins with environmental law.,from science to ethics, Ecology developed on the basis of ecological ethics, then introducing the details of the four factions of ecological ethics, this paper summarizes the connotation of ecological ethics insights on the basis of the previous; then starting from the relationship between the ethical and legal, to clarify the relationship between the ecological ethics and environmental law, the former is the basis of the latter, and the latter is the former dependent protection.The second part describes the first course of development as well as system content of our pollution charging system(including the development of principles and important terms), then on the theoretical basis of the previous text, analysis of pollution charging system contains the idea of ecological ethics, in the meanwhile,to the pollution charging system,the ecological ethics plays an very important role.The fourth part is a summary and reference of relevant experience from abroad.Foreign pollution charges mainly takes in the form of tax, partly takes in the form of pollution charging, however, through the analysis of the specific laws and regulations of the United States and British,we can also learn from the valuable experience of that.The fifth part proposes the ecological ethics countermeasures of the charging system in China from four main aspects which are content revises, government management, enterprise ecological ethics, public awareness of environmental protection. This paper argues that, excepting of learning economics and law reform measures,we should make use of the concept of ecological ethics to improve the implementation of the social environment of the charging system, only the government, enterprises and the public actively take action, which can ensure better implementation of the levy system, achieve more significant results.
