| Drug safety responsibility is very large. Now drug safety is in aperiod full of contradiction and questions. Drug safety incidentshappened frequently, and the public health and life safety is threatenedby those incidents. Therefore, the issue of government responsibility ofdrug safety supervision has become the focus and hot point that the mediaand the society care about. Responsibility is the core problem ofdemocratic politics and public administration.This thesis is structured by the following part:Introduction, this part explains the selected topic and the researchpurpose. It mainly talks about some famous transnational pharmaceuticalenterprises that concealed drug adverse events. The government shouldhave great responsibility in drug safety monitoring and supervisionsystem.The first chapter presents some problems about governmentresponsibility in drug safety supervision by some drug safety events. The grim situation of drug safety caused our expectation on governmentresponsibility. The current situation of government responsibility indrug safety supervision is worrying. There exist many problems, such as,not clear responsibility of drug supervision department, as the chaos ofthe supervision department, the lag of drug safety laws and the crisisof the public confidence on drug safety, which made the governmentresponsibility in drug safety supervision in the teeth of the storm.The second chapter analyzes the government responsibility in drugsafety supervision. The long term lack and vacancy of the governmentresponsibility in drug safety supervision has profound reasons andcomplicated background, for example, no law about governmentresponsibility in drug safety supervision, the chaos and disorder of thedrug supervision system, the weak responsibility consciousness andbackward manners of drug safety supervision, the lack of rules about drugsafety supervision, and the fatigue of accountability of governmentresponsibility and so on. Therefore, to establish, improve and implementthe drug safety supervision responsibility of the government becomes thelargest drug safety responsibility.The third chapter explains how to structure the system of governmentresponsibility in drug safety supervision. The legal system andsupervision practice of the government responsibility of the westerndeveloped countries has provided ideas and lessons for our improvementof the government responsibility in drug safety supervision. It discussesthe inevitability of government responsibility legalization in drugsafety supervision. It also presents legalization approaches of thegovernment responsibility in drug safety supervision. The first one isto make laws of government responsibility in drug safety supervision. Thesecond is to modify and improve the drug safety supervision law. The thirdis to implement the supporting measures of legalization of government responsibility in drug safety supervision. The forth is to implement theguarantee measures of legalization of government responsibility in drugsafety supervision.The subject in this thesis has a strong practical significance. Itis in line with the national conditions to highlight and strengthen thedrug safety supervision responsibility of the government. Researchapproaches adapted in this paper are: method of history combining logic,case analysis method, and comparative research. This paper also appliesrelative theory and method from the constitutional law and administrativelaw. |
