Research On Right To Life Into The Constitution From The Perspective Of Human Rights

As one of the human rights, the right to life does not only make sense in the sense of liberty, but also in the sense of social rights. The right to life is an indispensable part of our Fundamental rights system and therefore should be a part of constitutional rights system. However, the right to life was not written in the constitutional law in 1954,which causes the absence of constitutional protection on the right to life.The right to life written into the constitution is very necessary, firstly because in thus doing, it can better protect the rights of citizens, secondly because it can better perfect the system of constitutional rights, and thirdly because it can render it easy on our part to fulfill our international obligations. In a word, the right to life written into the constitution is of great significance. It embodies the reinstatement of liberty and reflects the perfection of social rights. It is the guarantee of survival rights of human rights, and also the support of development rights. The right to life written into the constitution is feasible in our current legal system. It has theoretical support of Rights-based theories, and also has the practical support of citizens’movements for the civil rights. It is very easy to include the right to life into our constitution system in theory and practice since the latter become more and more open.The right to life written into the constitution is imperative. The way in which it should be done, however, should be in strict accordance with our country’s basic conditions. In my opinion, in form, it should adopt a constitutional amendment and in content, it should advocate that everyone has the right to life, life should be respected by everyone and be restricted appropriately.Of course, to perfect the constitutional protection on the right to life, it is not enough if we only rely on the constitutionalization of the right to life; also important is to strengthen the connection between different department laws and the constitution.
