The Current Situation And Countermeasures Of Primary Court Civil Mediation

Civil Mediation is regarded as Oriental Experience by foreign. Court mediation system, although there are inevitable drawbacks, but still carry something, which is between the demand for judicial reform and the practical needs of China. Especially in building a socialist harmonious society and building the judiciary to promote the big mediation pattern of today, it has played a special role which can not be replaced by court judgment. This article re-examines and interprets the status of the court mediation and the problems of primary minority areas in China at this stage and puts forward proposals to solve the problem from the perspective of civil trial courts in order to promote judicial reform process. To save a considerable economic cost, and achieved good social effects, We should give full play to all over the National Folk civil mediation organizations such as Liangshan Yi Autonomous Prefecture Degu, and the role of the part-time mediators employed courts. To achieve the creative transformation of traditional cultural resources is clearly the urging solved problem. How to develop a creative manner mediation in the minority areas, it is worth considering.This article includes a total of four parts including introduction:The introduction includes four aspects. It explains the purpose and significance of this article, research related subject of both domestic and foreign, describes the object of this study, and describes the research method used.The second part tells the basic situation and the main methods of grassroots Court Civil Mediation practice. It includes three aspects. First it gives a brief introduction to the grassroots minority areas in Liangshan Court Civil Mediation and carrys out the basic situation of the main practices of civil mediation. --Third it tells the particularity of the social environment in Liangshan Autonomous Prefecture and the reform of the civil mediation in recent years.The third part analyses the problems of the mediation and explains the influence on mediation played by a wrong understanding. The fourth part gives some advices for the current problems of the National District Primary Court.
