The sustained growth in the proportion of the labor and employment market has made the non-mainstream and flexible labor dispatch become the worldwide employment trend, the most critical issue is how to handle the balance of the policy concerns employment stability and flexibility appropriately. In recent years, since the intensify restructuring of China’s state-owned enterprises and the objective factors for instance the motivation of the diversified employment patterns and because of the rapid increase in labor supply and the steady decline of traditional occupation, labor dispatch as a new non-mainstream employment type has acquired rapid development in China. Owing to the adaptation of the diversified and flexible requirements of labor market, broadening the employment channels for employee and reducing the human resource management costs of enterprise, labor dispatch developed swiftly. However, due to the special nature of labor dispatch and existence of the tripartite labor relations, which increases the precariousness and instability of the employee. Some labor units even avoid the legal responsibility to dispatched employee and the labor dispatch has become one method to reduce labor costs arbitrarily and evade legal responsibilities to some enterprises. Therefore, through objective analysis both the pros and cons of the labor dispatch of Yunnan province and introducing the issues of risk prevention and guarantee for legal rights and interests of the employee, this thesis presents the measures of prevention and control both the external and internal risk of labor dispatch, proposes the legislation and regulation for strengthening the employee’s legitimate rights and so it hopes to promote employment and reemployment through standardization of labor dispatch and for the active role of maintaining employment stability and building a harmonious labor relations in social and economic development of Yunnan province.
