The governments and people pay more and more attention to the control of greenhouse gasemissions as greenhouse effect and climate change issues are becoming more and more serious.the System of emission permits trade of carbon is built on the basis of Total Amount Control andcontrols greenhouse gas emissions by full playing the role of market mechanism and reduces theabatement costs effectively while reducing greenhouse gas emissions. Therefore, more and morecountries and regions have been established or start to build their own system of emissionpermits trade of carbon.As a developing country, China does not need to undertake mandatory emission reductiontask before 2012 in accordance with the provisions of the Kyoto Protocol. But as a large countryin greenhouse gas emissions, China is facing more and more pressure from the United States andother developed countries. China must establish and perfect their own system of emissionpermits trade of carbon, Whether it is in response to intense international pressure, or in order tosafeguard our national interests, the development of low-carbon economy and achievesustainable development. Chinese Government has all along attached great importance to theissue of climate change, actively taking measures to energy conservation, and developlow-carbon economy. Now, China has initially have the conditions to establish a carbonemissions trading system. However, the establishment and improvement of carbon emissionstrading system is a long, arduous and complex project, requiring all aspects of government,business, academics, the public long-term joint efforts. The author describes the relatedtheoretical problems on carbon emissions trading system in the text and put forward his ownproposal combining with China’s national conditions and the basis of advanced foreignexperience for reference. In order to make some contribution to the establishment andimprovement of China’s carbon emissions trading system. Papers carry out the discourse fromthe following four aspects: PartⅠis the introduction of carbon emissions trading system for the basic theory. Theauthor defines the concept of carbon emissions first ,that is a special kind of emission rights; thendefine the nature of the carbon emissions that is a special usufructuary right, a right todevelopment and also a public power with strong sense of private rights, then makes aintroduction on the concepts and classifications of carbon emissions trading. Finally, the authormakes a introduction on the theoretical basis of the carbon emissions trading system.PartⅡis the introduction and evaluation of national carbon emissions trading system. Theauthor has introduced the EU emissions trading system (EU ETS), the United States WesternClimate Initiative (WCI ’s), the Regional Greenhouse Gas Initiative (RGGI,), climate Reserveaction (CAR), Chicago Climate Exchange (CCX), Australia New South Wales Greenhouse GasAbatement Scheme (GGAS) and other carbon emissions trading system, evaluating theadvantages and disadvantages of these systems and pointing out that a system or practice whichcan be used for our reference.PartⅢis the analysis of the necessity and feasibility of carbon emissions trading system ofChina. The author analyzes the necessity of building carbon emissions trading system in Chinafrom five aspects including China facing increasing international pressure as a large country incarbon emission, after the Kyoto Protocol negotiations difficulties, safeguarding nationalinterests and to follow the international trend to seize the development opportunity, thedevelopment of low-carbon economy and achieve sustainable development. And then hediscusses the feasibility of our country to build a carbon emissions trading system from the sixaspects of the theoretical foundation and government support, policy and law, related systems,science and technology, and practical experience .PartⅣ, the author put forward his own proposals on carbon emissions trading system ofChina. He put forward overall vision of China to build a carbon emissions trading system. Hethinks that carbon emissions trading market of China should be included in the internationalmarket and domestic market at two levels. The establishment and improvement of carbonemissions trading system of China may rely on the national planning, to take "three-step"approach, then the principle of establishment and improvement of China’s carbon emissionstrading system should adhere to the principles include: coordinated development of the principleof development priorities, long-term, progressive, systematic, market, the combination of government the principle of efficiency, fairness combination of the principle of justice, theprinciple of openness; followed by the author from a carbon emissions trading, the main objectof the carbon emissions trading, the setting of total carbon emissions, carbon emissions of theinitial allocation, carbon seven aspects of the transfer of emission rights, carbon emissionstrading, regulatory and legal responsibility for the establishment and improvement of China’scarbon emissions trading system to the specific recommendations.
