The Study On The System Of Rural Land Expropriation Procedure Of China

Along with the rapid development of China’s economic and social, lots of lands are requiredobjectively, therefore land expropriation occurred frequently. Meanwhile, due to ourImperfect land expropriation procedures, there are endless social contradictions and conflictscaused by land acquisition, which has become a mean reason for group events andcommunity appeals for help. Based on stand legal process, this article analyzes the defectsand causes of China’s land acquisition legal procedures normatively, and summarizes andLearn from the experience of other countries and territories, proposes a number ofrecommendations to improve China’s land acquisition procedures.Theory of land acquisition procedures is introduced. From the concept of the land acquisitionprocedures, it focuses on the standard legal procedures including its origin, development,values and basic requirements. Finally this chapter analyzes the necessity of standard duelegal procedures in our land acquisition system.Analyzes the shortcomings of China’s landacquisition procedures. Through normative analysis, this chapter points out the defects andcauses of our current land acquisition procedures.According to the legal requirements, anumber of specific recommendations are raised to improve China’s land acquisitionprocedures. From acquisition announcement, survey of land acquisition, public interestsidentified compensation and resettlement, remedies and other sides, series of proposals areraised to improve China’s land acquisition procedures.
