A Study On Maritime Dispute Solution Mechanism Of China In The Current Circumstance

In recent years, with the economic development of China, shippingindustry has shown a rapid growth and shipping resources are gathered inChina. However, this brings large amounts of maritime disputes andissues. Because of some pre-existing problems, our shipping disputesresolution mechanism is not capable to solve the new problems we keepencountering in real practice, especially when Shanghai is building itscenter place of international building, the discourse right seems to beessential for Shanghai, and maritime arbitration and maritime judge playcentral role in acquiring the discourse right. This paper conducts study onthe development of shipping dispute resolution mechanism under the newsituation.Through the study of the dispute resolution mechanisms ofdeveloped countries, this article analyzes the current situation andexisting problems of ours, proposes original ideas and theories to makethe current mechanism be geared to those in developed countries, studies the relationship between maritime judge and arbitration and studies howto make them function well in their own area, and provides originalthinking on bringing the Chinese acquaintance society theory to revoluteshipping mediation issues.
