On The Issue Of China's Maritime Disputes

The earth of human life is made up of land and sea,and the sea area accounts for about 71% of the earth's surface area.With the continuous development of human society,the excessive use of land resources leads to the fact that original land resources cannot appease the demand of human resources,which makes the huge ocean key so that huge benefits also let this blue waters become the captured and contested target.In order to prevent international disputes from being cause for the competition of sea rights,the United Nations in 1982 proposed to "United Nations Convention on the law of the sea".In suspect of law,"United Nations Convention on the law of the sea" gives us a detailed explanation about contiguous zone,exclusive economic zone,the continental shelf and other new concepts on the territorial sea,but ahead of great interest,the inherent weak law cannot restrict international maritime disputes so that gradually,it becomes problem of international disputes which cannot avoid in the world.In the report of the Seventeenth National Congress of the Communist Party of China,it is proposed to combine the "bring in" and "go out".This shows that China development of economic,political,social,cultural in future is inevitable with all the countries in the world,so undoubtedly,relying on the sea and out of the sea is an important springboard for China to be a world power.But the reality is that there are many dispute of sea among Chinese surrounding neighbors,such as sea delimitation,reefs and marine resources management,and even relating to the delimitation of sea between countries overlap.The problem of dispute of China maritime rights is urgent to solve.This article is divided into six parts.The first part is the introduction of the reasons,meaning,overseas and domestic research status,thought and methods,and innovations;the second part introduces Chinese four practical problems about the current dispute maritime rights,namely the demarcation of the East China Sea conflict,the Yellow Sea marine resource exploitation,the South China Sea Islands dispute and its channel blocking problem;With the theory of international relations as a guide,the third part explains the reason of the dispute of maritime rights and interests in the respect of international politics,international economy and culture of;the fourth part describes the basis on China internal foundation of marine rights and interests,which is made up with the legal concept,a strong clear and reasonable the power of science and technology and strong protection of capital and security;the fifth part summarizes solution to disputes of ocean in China;sixth part is the conclusion part of the paper,which summarizes the whole thesis and except the fact that China can solve maritime dispute as soon as possible to ensure that Chinese marine rights and interests will not be violated forever.
