As the growing demands for clean energy and acknowledgement of nucleartechnology, developments in civilian nuclear industry show an irreversible tendency.Controlling of nuclear accidents is the core of international civilian nuclear law. Ininternational plane, a legislation system focus on civilian nuclear power projects hasbeen basically established. The system offers requirements and standards for civiliannuclear power projects from perspectives of ‘before the accident’,‘during theaccident’, and ‘after the accident’. However, when invoked in practice, someproblems exist. For states, they should cooperate with each other by reaching bilateralor multilateral agreements to promote and to make up for the international system.Two7-degree nuclear accidents happened within3decades, which brought hugeinfluence to the vitality of the safety standards of civilian nuclear usage and alsopromoted relevant legislations. The Chernobyl Accident was a huge imputes for theprogress of international civilian nuclear law. And the Fukushima Accident againraised problems and challenges for both international law and national laws.Civilian nuclear power has a very promising future in China, whereas the currentnational law in this field cannot meet the required demands. Once China attacked byany nuclear accident, current national laws cannot back up for appeals for damages.Enacting Atomic Energy Law and promoting other legislations in this field,establishing a Chinese legislation system of ‘before the accident’,‘during theaccident’, and ‘after the accident’ and by co-work with other states or internationalorganizations, like the IAEA, can make a lead in China’s future development incivilian nuclear power, at the same time, countermeasures to cross board damages canbe drew when necessary.
