Trademark rights is related to civil subject, which determined the ownership of thetrademark process by the statutory authority through administrative or judicial procedures. Asthe most important part of "trademark law",Trademark rights system is the prerequisite andbasis for comprehensive protection. To set reasonable program could quickly security anddirectly affects the principal trading market. It also ultimately influence the market orderstability and orderly. Now, the third revision of the Trademark Law comes the occasion andhas profound implications. Based on the trademark rights of the meaning, characteristics andprinciples of law analysis, This paper makes a comprehensive interpretation of trademarkrights. Learned from the United States, France, Britain typical analysis of trademark rightsprinciples; reviewed the administrative system of two aspects judicially for application,examination, opposition, revocation and litigation procedures. The United States, Britain,Germany, Japan, and China’s trademark rights system were analyzed and compared withChinese foreign trade mark indeed. We should care about summarizes of similarities anddifferences of our trademark rights problems in trademark opposition system and thetermination of the system. Trademark rights should review of judicial proposals and otheraspects of convergence. Our trademark rights to the reconstruction program should be a cleartrademark rights position which is executive and the judiciary. Making the establishment ofspecialized courts and other intellectual property rights. Trademark rights can improve thesystem though providing the third revision of the Trademark Law which can learn from theexperience and references.
