Research On Intellectual Property Protection Of Railway Transportation Industry

Since the invention of the railway, it plays an important role in the history oftransportation and cultural development. Railway which has the merits of large carryingability, lower energy consumable, less pollution, strong security, less land occupation and soon is a kind of ideal transportation mode. It is known as"green transportation". In the 21stCentury, the age of knowledge-based economy, intellectual property rights, as a kind ofintangible asset, is the most important economic resources of the industry. There is no doubtthat intellectual property rights play an important role in improving enterprise's kernelcompetitive and gaining long-term development in market economy. On June 30, 2008, theState Intellectual Property Office and Ministry of Railway had signed cooperation frameworkagreement on intellectual property rights. The signature of the agreement represented a majorstep in implementing Outline of Intellectual Property Rights Protection. As the first nationalpilot of intellectual property rights of industry, the signature of the agreement is the importantmilestone in the process of management and development of intellectual property rightsprotection of Chinese railway industry. However, there was only a pilot in 2008 and no relatedstrategies had come out yet.Based on the above, at first, the paper deals with the importance of intellectual propertyrights protection of railway transportation industry, including the importance ofimplementation of the intellectual property rights protection of the railway transportationindustry to the development of the whole railway transportation industry, enterprise legalrisk prevention and the management of the enterprise. Then, through the study of theintellectual property rights protection of rail transportation industry of developed countriesand the introduction of the intellectual property rights protection situation and development ofrailway transportation industry of Japan, Germany and France, the paper draws a conclusionthat the greatest feature of the railway transportation industry of developed countries is itsinseparable connection with the rail technology. While the degree of development of railindustry and the perfection and protection of the intellectual property rights are inseparable.To intellectual property rights protection problems appeared in the railway transportationindustry, finally, this paper puts forward some relevant proposals. The proposals includeenhancing the awareness of intellectual property rights protection of railway transportationindustry, establishing intellectual property rights protection of railway transportation industryadministration, improving the patent system of industry, protecting relevant patented product,strengthening protection of relevant trademark of railway transportation industry, enhancingthe copyright protection of railway transportation industry and paying great attention to the domain name protection of the railway transportation industry and relevant industries. It isalso important to protect the intellectual achievements of the railway transportation industryactively and let relevant intellectual achievements play a function of their own to the highestextent. These measures are all very important to maintain sustainable development of therailway industry, enhance competitive advantage of key enterprises of the railwaytransportation industry and strengthen the competitiveness of Chinese railway transportationindustry in the field of international transportation ation. In that way, it can meet the growingneeds of the society and promote the sound and rapid development of national economy in thenew situation.
