Discussion On Issue Concerning Infringement Act On The Internet

Along with the network popularization, the more people online communication,speech, commodity trading activity etc. The network has become the indispensable partinlife, affecting people live, work, entertainment and other aspects. Network in givepeople bring convenient while, also brought harm. In recent years, the network tortcases occur repeatedly, but also shows ascendant trend. With the network the infringingact is not harmonious, our country law is still does not have special laws to sanctions,judicial practice in cognizance network tortfeasor responsibility, often with difficulties.These are caused by our research network tort reasons.The first chapter of this paper introduces the concept of network infringement,features and analyzes the causes of network infringement in the technical, legal, ethicalaspects and manifestations. As the significant part of this paper，the second chapterintroduces the indentified analysis on the network infringement. This part mainlydescribes the basic elements in subject，the attributable principle，responsibility，brieflyintroduces the major categories in current network infringement. The last partsummarized the present status of network tort and the shortcomings，combined with theadvanced legislative experiences, the author puts some ideas and opinions.
