Technical Structure Of Promoted Economic Legislation

The promoted economic legislation is the outcome of economic development which has beento a certain stage. Different from general"management legislation", it usually emerges with theadjustment of the industrial structure and policy and has higher flexibility and policy.Since thereform of opening up, our country have established a series of economic legislation which are titledwith promotion.These economic legal provisions play an important role in economictransformation and economic structural adjustment of our country.Meanwhile the legalcharacteristic of the promoted economic legislation has been questioned since it bias to the policy.This paper will do a comprehensive and in-depth analysis of promoted economic legislation, in asystematic way based on the characteristic and technical structure of law of the promoted economiclegislation.This paper will mainly discuss the following four aspects: the formation of the promotedeconomic legislation;the internal relation between promoted economic legislation and economiclaw；the value and significance of promoted economic legislation; and the dilemma and solutionof the technical structure of the law.Chapter one defines the promoted economic legislation. It highlights the characteristics ofpromoted economic legislation and theoretically defines the promoted economic legislationthrough the angles of the formation background, theoretical, political, economic base and innervalue of promoted economic legislation. Moreover, a comparison between promoted economiclegislation and promoted regulation legislation will also be illustrated.Chapter two examines the legal technical structure of promoted economic legislation with thefocus on lingual expressions, standard structure and frame structure.Chapter three discusses the dilemma of promoted economic legislation in practice stage.Chapter four is about the future trends of promoted economic legislation. The economy ofdeveloped countries stared earlier than China,so does the present of promoted economiclegislation in these countries. Though they didn’t directly titled the economic legislationwith"promoted", the essence is exactly promoted legislation. This chapter make a comparison andreview of the promoted legislation among typical countries/regions such as the US, the Europe,Japan etc to get experience which is worth learning. Based on the borrowed experience, this paper will try to explore the promised paths of promoted economic legislation in the aspects oflegislative techniques and inner value.
