China's Rare Earth Trade Issues Of Legal Research

On March13th2012, United States, European Union and Japan joined forces againto file a lawsuit at the World Trade Organization against China on the exportrestriction of rare earth after China lost the raw material case in2009, which wasruled by WTO Dispute Settlement Body’s panel. Under such international situations,how to get rid of the dilemma lying between different needs of the rare earth amongcountries and possibly alleviate the tension resulted from international trade of rareearth would be the key point to avoid the same mistakes made in the last exportrestriction case on raw materials. This paper is going to carry out a deep research anddiscussion on this topic, which would hopefully render some targeted suggestions andresolutions in order to help China and its relevant authorities better deal with the rareearth trade dispute in the context of WTO rules to defend our country’s dignity andlegitimate national interests.
