Land is a national strategic resource, and the foundation for the sustainabledevelopment of the nation. However, since the last90s, due to the fast industrializationand urbanization of China, the demand for constructional land has been growing rapidly.As the city area kept on expanding, a lot of collective land was taken by the governments.Meanwhile, because we do not have complete and fair expropriation laws, cases likeillegal expropriation and over-taking of farmland arose in many places, resulting in a sharpdecrease in the farmland resource which had always been rare. On the other hand, becauseof the low compensation standard, expropriation beyond the legal limit, unfair distributionand poor management of the compensation budgets, lack of transparency in the work afterexpropriation and failure to guarantee the welfares of the farmers who lost their land, thefarmer’s interests are badly hurt and many farmers went to the superior governments toprotest, which brought bad impact on the stability and development of the society.Therefore, it is urgent to establish compensation policies which are in line with the law ofthe economy growth and the long-term of the farmers. In view of the situation above, Imade a research into the current practice of the land expropriation and compensation inZengdu district of Suizhou and discovered many problems inside. In this paper, I willexpand on those problems and put forward my suggestion of solution on the existingproblems.This paper is made up of foreword, main part and conclusion. The main part consistsof three parts as well, with content summary as follows: Part one is a legislationbackground of expropriation and compensation, introducing mainly the laws and policiesrelated with expropriation and compensation in China; The second part is an introductionof the practices of expropriation and compensation in Zengdu of Suizhou and an analysisof the problems resulting from it, such as ambiguous compensation principals,unreasonable compensation standard, confusing compensation interest-related parties, andlack of remedy ways; On basis of part one and part two, part three gives some suggestionson how to improve the current compensation practice, involving legislation and farmer ’ssettlement.
