The Perfection Of The Compensation System For Rural Land Expropriation In China

The rapid urbanization process in C hina has resulted in extensive expropriation of rural land.Now the current system of rural land expropriation was imperfect.Frequent land expropriation disputes has aroused great social concern,and most problems involved land expropriation compensation.Imperfect system of land expropriation compensation has seriously encroached the rights of land expropriated farmers,and seriously affect social stability.In order to protect the rights of land expropriated farmers and maintaining social stability,it is very essential to improve the system of land expropriation compensation.With the help of previous studies and through investigating the related literatures,this thesis found out the existing problems of the system of land expropriation compensation.It is mainly including the opaque decision-making in land expropriation compensation procedure;the irrationality of the compensatory cost allocation;the lack of judicial relief procedure,and etc.But in the entity,indefinite relevant conceptions,low standard,narrow range and less way of compensation has been seriously affected the rights of land expropriated farmers While in developed countries,this aspect work started early,and it has founded a mature system of land expropriation compensation.Based on the experience from developed countries and combine with our country,this thesis provide some measures: Procedural simplification;procedural democratization;introduce judicial remedy as the last resort;clear the compensation principle;set a reasonable compensation standard;a distribution plan for the benefit of the value-added part;enlarging the compensation range and increasing the compensation method.To improve the system of rural land expropriation compensation,this thesis try to solve problems in procedure and the entity with those measures.
