The Internet in China is growing today, we are fortunate to witness the "3Q war ",This huge influence of the network war has aroused widespread concern and sparked ahot Internet security to user privacy. As the monopoly of the Internet in China related toinadequate legislation to deal with disputes, lack of maneuverability, so this will be thepremise of "3Q war", for example, to discuss legal issues around the Internet monopoly,in order to monopoly issues related to the analysis of Internet to clarify the internetmonopoly of legislative status quo and its shortcomings, the monopoly of China’sInternet-related legislative proposals, put forward a sound in order to better adapt to theneeds of social practice.In this study, divided into four parts, the first part of the Internet monopolyoverview of the problem is analyzed, focusing on Internet monopoly theory and thestatus of Internet monopoly. Their status, the main distinction between the Internetindustry entered the oligopoly stage by the stage of the monopolistic competition,oligopoly trend is worsening, the monopoly of a worrying trend and the monopolistictendencies of the relevant departments should attach great importance to the Internet.The second part analyzes the monopoly by "3Q war" to see the Internet-relatedissues."3Q war" Internet boom since the first massive affect very wide areas of theenterprise network war. Through a brief review of "3Q war" that the Internet monopolyissue has long ignored the anti-monopoly laws and regulations related imperfect,antitrust regulatory mechanisms are inadequate to draw the ultimate goal of the antitrustlaws one is in the changing market environment, we must always safeguard thelegitimate rights and interests of consumers.The third part described the Internet monopoly of legislative status quo and itsinadequacies. Is particularly important to the order of the network and network security,and information security and protection of the rights of network users, networkenvironment, the competitiveness of enterprises, especially the monopoly of the needfor competition governed by the laws and regulations to maintain the good order of thenetwork, to protect the Internet each the interests of users is imminent. The authorbelieves that the main criticisms against Tencent, but the abuse of monopolisticbehavior. Only, due to domestic antitrust law system is still in the "embryonic" period, but also the lack of adequate legislative provisions to meet the requirements of itsoperability.The fourth section presents the perfect proposal for Internet monopoly legislation.This part analyzes the "3Q war" is a good opportunity to promote similar within theInternet industry vicious competition events resolved by the judicial level. Asked thecountry should, in the Legislative clear legal constraints, the development of a speciallaw for the protection of software, and specify the administrative departments tostrengthen anti-monopoly law operability; clear software product managementdepartment and the division of responsibility, clear the power of the industryassociations; strengthen the responsibility to protect the interests of users and number ofrecommendations.
