Respond To The Economic Crisis Economic Law

Since the implementing of reform and the open policy, our country has centered ondeveloping the market-oriented economy.With the participating in the WTO，Ourcountry has stepping in the world economy system；With the fast development ofeconomic integration and economic globalization，the world economy fluctuationgradually influence the economy of our country. Especially, in recent ten years worldeconomic crisis has affected our domestic economic structure directly or indirectly. Thethesis, as regards these phenomena, adopt the method of the empirical analysis from theperspective of the science of law to analyze the living example in the world historyaiming to exploring the general law of economic crisis. The author holds the claimthat the roots of economic crisis base on the contradiction between private ownership ofproductive means and Production Socialization which resides in the market-orientedeconomic system. Although our country carries out the socialism market-orientedeconomy, basic contradiction can’t be avoided in our economic activities. Then，thethesis employs the contrastive analysis method to contrasting the measures adopted tocope with the economic crisis and the manifestation and effects in law in differentcountries. Summarizing the experiences from other countries and analyzing thecorrelations between different factors, we collect the induction factor of periodic burstseconomic crisis. Finally, the thesis adopts the method of qualitative analysis arrivingat the following conclusions：In order to relieve the contradiction in market-orientedeconomy system,we should enhance the stability and effectiveness and boost theresistibility in economic crisis to ensue our economy develop in a healthy and stableway. We can regulate the scales of the real economy and virtual economy We canregulate the scales of the real economy and virtual economy and make a special effort todevelop the virtual economy. By the improvement of the property and tax revenuesystem to narrow the gap in residents’ income；By perfecting Legal systems forBanks， establishing Professional bank and other measures to promote theMulti-development Mode of the banks, to loosen financial regulation，to add newFinancial Product， to offer more channels to resolve financial problems ofsmall-and-medium.The thesis includes five parts. The first pert introduces the significance ofSubject-selecting and reviews the present research in this field, in addition the layout of this thesis and research method. The second part expounds the concept of economiccrisis and its characteristics and analyses the typical case studies, then conclude theroots of economic crisis and gain enlightenment from them. The third part presents thecause of the science of law and the economic crisis. The fourth part gives a account ofthe unique functions of law in economic crisis.，effectively control the market and avoidgovernment failure to waken or avoid the occurrence of economic crisis. The fifth partis the core of the thesis, the author advances the measures to cope with the economiccrisis according to the economic law.
