The Hotel Security Obligation System Research

Hotels have shouldered the obligation of protecting safety of human life andproperty since their beginning. With the rapid development of hotel, a large numberof disputes on violation of safety guarantee obligation take place in hotel. Judicialcircles and scholars have a lot of controversies on legal nature and legal liability ofthese cases. The essential reason to this phenomenon is that the systerm of the safetyguarantee obligation of hotel hasn’t built in our country.This paper defines the operator to hotel and discusses the safety guaranteeobligation of hotel. The safety guarantee obligation in two law systerm has importantreference value to build the system of safety guarantee obligation of hotel. Therefore,this paper first analyses and compares the origin and development tendency of thesafety guarantee obligation in two law systerm, and this helps to build the system ofsafety guarantee obligation of hotel in our country. Next, combining several theories,especially related theories of Neo-institutional Economics, this paper demonstratesthe rationality and necessity of building the system of safety guarantee obligation ofhotel.Then, this paper mainly discusses the concrete contents, legal nature and legalobligation of the safety guarantee obligation of hotel in three chapters to build theframework of safety guarantee obligation of hotel. In the end, by combining theexistingrelevant theory abroad of the safety guarantee obligation in two law systermand domestic condition, this paper puts forward several suggestions on building thesafety guarantee obligation of hotel. Through the safety guarantee obligation of hotel,the author hopes to better protect consumer interests, regulate the behavior of hoteliers, and also topromote the healthy development of the hotel industry.
