Criminal Prosecution Witnesses To Testify System Research

The testimony of witness is crucial to criminal procedure, under some certain circumstances the testimony of witness plays a determining role in examinating the facts which the defendant claims. However, the status quo is quite unsatisfying with the very low rate of court. Because of the absence of litigation and other reasons such as tradition, very few of witness are willing to appear in front of the trial. So it is urgent and justified to establish a well-devised and effective system of witness.The following dissertation tries to talk about the path of forming the compulsory attendance and testimony of witness,making improvement of current system of legislations related to witness. This paper consists of four parts:firstly, the author introduces the concept of legal terms including witness testimony and court. Secondly, talking about the legislation and practise of witness of testimony in foreign countries. The third part conveys a detailed analysis on current situation of testimony of witness based on social system, Finally, the fourth part is the conclusion and the key point of this article, putting forward some suggestions concerning establishment of the witness system.
