Property Dispute Resolution Path Analysis

Since the reform, especially since the reform in house system in 1998, China has seen a rapid development in real estate industry, and house commercialization has been speeded up accordingly. Therefore, house property management has come into our daily life. Along with that, disputes related to house management have increased with each passing day, involved in all aspects in house management. Any improper handling of such disputes related to residents’interests might cause conflicts or unexpected events. Thus, a proper handling of the disputes in house management would be of much importance to harmony and stability of the society and economic development.Accordingly, the present paper has made an analysis and discussion of the disputes and approaches in the following four aspects of house management disputes.Part I, General description of house dispute. Through the concept of house, house service and concept of dispute in house management dispute, the characteristics and present status of property disputes have been pointed out. According to certain standards, property disputes have been classified.Part II, According to the problems in the House Dispute, a general introduction to the present status of property disputes have been made. An extensive analysis of the causes led to the property disputes has been made, upon which principles to solve the disputes have been proposed.Part III, Approaches to property disputes have been described from the angle of litigation. An analysis has been made of the current laws and regulations to solve property disputes. Handling and reform trend of four kinds of common property disputes have been pointed out.Part IV, From the angle of non-Litigation, approaches have been discussed. First, a general presentation has been made of the relevant studies at home and abroad. A comparative analysis of the international ADR and function of China’s traditional coordination has been conducted. Then a method and approach has been discussed using ADR to solve property disputes. At the end of the paper, the present difficulties to solve the disputes have been mentioned and counter-measures and proposals have been worked out.
