Research On The Changes Of Environmental Criminal Law Of China From The Criminal Law Amendment

In the1997edition Criminal Law, a more concentrated method was adopted to define the Environmental Criminal. From then on, NPC Standing Committee amended the environmental criminal stipulations, by establishing Criminal Law Amendment, for several times. Through analyzing the modification of Criminal Law Amendment, a path of alteration in Environmental Criminal can be draw. The reason facilitate Environmental Criminal make regularity alternation can be conclude in following two aspects. Firstly, while basic theories of Environmental Criminal become more sophisticated, the legislation is facilitate to change correspondingly. Secondly, in order to compensate the deficiencies of practicing of environmental protection is depend on constant consummating of environmental criminal. From the aspects of environmental criminal stipulation, not all the sophisticated theories and valuable experiences can be adopted in environmental legislation. Therefore, although after several times of amending, environmental criminal still need to be revise. The theories and experience which are not adopted will power amending of environmental criminal. The primary content of this paper is, on the base of analyzing the reason why environmental criminal alter, discovering the deficiencies in environmental criminal, absorbing the reasonable factors in the theories and practice experience and applying reasonable suggestions for amending environmental criminal.
