Legal Research On College Disciplinary

The disciplinary during the school relates to the future and destiny of college students, in recent years, more and more court cases happened between the students and college, aroused widespread attention from scholars. There are different understandings of the law in the college disciplinary. College discipline and punishment are also common in the illegal of the main part, the program, the evidence collected, the discretionary punishment, the disciplinary monitoring and many other issues.And at this stage of the study are still in the theoretical level of legitimacy research,the due process, and the protection of students’ interests. This paper combines the provision of university disciplinary action, complainant management approach and foreign university disciplinary management system. To analyzing the legal issues from both theoretical and practical aspects of discipline and punishment of college students, and propse the solution. In order to facilitate the healthy development of our college discipline and punishment.This paper is divided into four chapters. The first chapter is about an overview of the characteristics of students’ disciplinary. Focuses on the college disposition of the legal nature and the practical basis.Drewing a distinction between discipline and llegal and unethical behavior. The second chapter is a comparison between the chinese college disciplinary management mechanism and the abroad. Selecting American Universities disciplinary mechanism as the typical to comparison and analysis with our universities’ in general, and propose several aspects that we should learn. Chapter three is the process of college students disciplinary action problems. Pointed out the deficiencies and problems to be solved under the current system. Chapter four is to provide specific legal advice. In this paper, a comparative analysis of domestic and foreign, and to be integrated with China’s specific conditions. the specific legal advice is the raised in the main level of the college disciplinary.
