In21st Century, Internet has gradually become an essential part of everyday life.It has openness and freedom alternative, advancement and imperceptibility fornetwork technology, which lead to the cases involving infringement of networkprivacy common occurrence, Privacy rights of a natural person suffer from challengesand threats, and Internet is no longer a pure land which is far from law rather than thebeginning of Internet. For the above reasons, Human could obtain information withmaximum degree, rapidly, freely and easily due to Internet, meanwhile, a necklace islocked up to Human. In this country, the both the theoretical research to networkprivacy and protection at the levels of legislation and judicial practice are stillrelatively backward. Therefore, Establishment of the protection system for networkprivacy is particularly important in this country. In this thesis a protection system fornetwork privacy which is suit for our national conditions is attempted to explorethrough a comprehensive analysis. Thesis is divided into4chapters:Chapter One is an introduction to network privacy. In this chapter the basicmeanings such as privacy, privacy rights and network privacy have been discussed,particularly, analysis to contents regarding to network privacy, the specialcharacteristics, and form of expression for infringement act, the reason and importantsignificance to improve protection for network privacy also are described.Chapter Two is the mode of protection for network privacy based on civil law.In this chapter the protection mode of the both UK-US legal system and mainlandlegal system, the laws related to network privacy in EU have been introduced, and isexpected to provide references for our protection for network privacy throughexploring reason and seeking truth.Chapter Three is the current situation of protection for network privacy. In thischapter, firstly, the relative protection based on civil law to privacy rights andnetwork privacy in this country are introduced, further the existing issues and the actual troubles in legislation protection of network privacy in this country areperformed an analysis, improvement of the protection system for network privacy hasbeen presented in the views of urgency and necessity.Chapter Four is protection improving to network privacy. Firstly, in this thesis aSWOT to the both main protection modes existing of organization self-disciplineand legal regulation for network privacy in the current world has been performed,and combined with the actual conditions in this country, and define which is ourchoice for protection mode for our network privacy. Secondly, a legal protectionframe for network privacy is assumed in our country fearlessly, accordingly, theassumption includes the relative contents regarding to protection scope of networkprivacy, the rights and the obligations subject of right and subject of duty fornetwork privacy in detailed, the regulations regarding to methods of bearing tortiousliability for network privacy.The other suggestions involving protection of networkprivacy such as establishing protection of organization self-discipline and carryingout Real Name Registration, etc. are offered, the various measures would beperformed at the sane time and expected for structuring a complete protection systemfor network privacy in this country and realizing sufficient protection to networkprivacy...
