Study On The Standardization Of Legislative Language

Start with the language for legal research object, therelationship between law and language, with linguistics theory analysis legal activities,the language so arises at the historic moment. The legislative language in China beganto research in the1970s,80s, mostly in linguistics theory system for framework, andgradually build a legislative language system. With the development of research,semantics and pragmatics theory causing more and more scholars’ attention,legislative language research seems to pushing in pragmatics and semantics ofdeepening the direction. From a pragmatic and semantic theory, according to the dailybehaviors of Austin and Wittgenstein theory research and the accuracy of legislativelanguage fuzziness, although they had made some achievements, such as theuncertainty and fuzziness of the dialectical understanding of both the understanding ofthe interaction, the affirmation of the words of fuzzy semantics, and so on, they didnot radically solve the problem of anomie legislative language.This article begins with the basic connotation and denotation of legislativelanguage, and mainly analyzes the present situation of the legislative languageproblem which is based on the anomie phenomenon and summarizes it. This articleaims to explore the language of the law construction path. This article chooses sometypical materials from the state formally promulgated the current laws, magazine,newspaper, judicial cases. We summarized these materials with the integrated use ofsemantic analysis, grammatical analysis, and the style analysis and pragmatic analysis methods. We then summarized legislative language vocabulary, sentence and stylecharacteristics which are based on these methods. At last, we have a discussion on thestandardization of the legislative language which is based on these characteristics thathave been summarized before.
