The right to adequate housing is a kind of citizen’s basic right.The most basic of human survival and development resources maintain by Basic necessities,and the ancient Chinese have been said "tens of thousand,cold the shelter soil of the world delighted to as an ideal state".Residential was so important,but it is not only a house that is the home of the carrier.The housing not only the place of life,work and rest,that is the people to maintain personal dignity,enjoying the life,improve self-carrier.So form the perspctive of human basic rights,everyone should have the right to housing.Respecting and protecting the right to adequate housing is the rresponsibility and the duty of the nationality.The low-rent housing system is an important part of housing security system,which the government getting involved the housing market,and Resolving the housing problem of the low-income families.Currently,China has preliminary set up the loe-rent housing system in most cities and has achieved a certain degree of social effects after more than ten years’exploration.The housing problem has played an important role.Resulting in "low-end security,high-end market"on the basis of the "sandwich class"has become increasingly prominent and new employment and housing problems of migrant workers began to be concerned.Because this system has been implemented in the primary development stage,there exists many problems in practice,influenced the exertion of availability of this system.So analyzing thoroughly the low problem in the low-rent housing system,there is very important academic merit and practical significance for the construction of low-rent housing system..On the foundation of existing research,this article analyzes the jurisprudential theoretic foundation of the low-rent housing system,and puts forward the necessity of building the low-rent housing systenm,and to legalize the low-rent.It is to intensify efforts to protect low-rent housing,to expand the ratio of housing rent and to adjust monetary subsidies dynamically by improving the level of low-rent housing legislation.And it is also necessary to set up long-run allocation of low-cost rental housing as well as a strict liability system in order to realize the virtuous circle of low-rent housing security system.In the paper,with the execption of the introduction and the conclusion,it is divided into four parts:The first part,General sistuation of the low-rent housing system. Via the analysis of the housing problem.this article inquiries into the reason of output of the low-rent housing system.And via the analysis of the legal theory basis of the low-rent housing system.Extended through the analysis of the social function of the low-rent housing system and the legal basis of the need to build low-rent housing legal system.The second partdiscusses the loe-rent housing legal issues in our country. Through the analysis of the development of our existing low-rent housing sysytem,in practiceof the problems of China’slow-rent housing system,sucn as the high cost of the loe-rent housing,a shortage of funds on the construction,lack of accurate access to exit mechanism,imperfect system on the laws and regulations,the legislative level is inferior.The third part through the research the developde countries housing security system.To improve the level of low-rent housing legislation with arrive revelation.Abd expand the low-rent housing sources actively, establish and improve audit exit low-rent housing mechanism.The fourth part is proposed to build inexpensive housing legal system.To build low-rent housing legal system should follow these relevant principle,such as:the principle of administrative feasibility,the principle of residential protection on moderate level of protection coordination,the principle of particular objects,the principle with flexibility combining,the principle of dynamic dajustmen.By increasing the low-rent housing availability for low-income housing difficulties,the low-rent housing funding sources should implementation,to improve the housing rental subsidies.And to expand the coverage of the low-rent housing gradually,then to support build the implementation of the low-rent housing legal system by supporting policies.
