On The Consummation Of System For Constituencies To Recall The Member Of The People’s Congress

The system of People’s Congress is the basic political system of our nation. The National People’s Congress (NPC) and the Local People’s Congress (LPC) elected by the people including their standing committees are the organs of the state and local power. Basic on the Constitution and Election Law, the Deputies to Local People’s Congress in county and township are elected by the constituencies directly, and supervised over by them, too. The constituencies in the electoral districts of the Deputies to LPC can recall him. It is a characteristic for socialism countries to recall their Deputies to LPC. The system of recall Deputies to LPC directly is built to show the status of people. Recall is the most severe way to supervise over the Deputies to LPC. Thus, constituencies can control the Deputies to LPC effectively.However, the news in recent years reflects a lot of problems of the recall system. It is difficult for constituencies to make a recall application. The body which has the right to make a recall application has been transferred indirectly. The different figures in LPC and in a job of the Deputies to LPC are mixed. Recall has become a political way to resolve a civil dissention. The power in recall of the standing committee of the LPC at the level of county is not clear, and exertion of the power is not lawful sometimes. All of the problems are focus on one point:the recall system hasn’t provided a feasible process for the constituencies, Deputies to LPC at the level of county and the standing committee of the LPC at the level of county. Thus, all of them do not know their right and power clearly, and it is difficult for all of them. So the objective of this paper is to deal with these problems in law.Besides the Introduction and the Epilogue, this paper contains four parts.The first part discusses the law system of constituencies recall Deputies to LPC directly and the meaning. It contains four small parts:its history, its theory basis, its law system and the problems in the system working. When we discuss the problems in the system working, we analyze the law and the statue firstly, and then analyze the actual problems by the cases of recall Deputy to LPC at the level of county. Finally, we sum up the affect. The second part discusses the reasons for the problems, including the limitation of the election law system, the lack of the ways to supervise, the serious problems of the recall law system. Especially, it analyzes the key reason, the recall law system.The third part reviews the recall system abroad, and makes a compare of our recall system and the recall system abroad.The last part discusses the consummation of the recall system. Firstly, it demonstrates the necessary and importance to consummate the recall system. Secondly, it gives the constructive suggestion to consummate the recall system from several aspects. It includes the application of recall, the check of the application, the formal start of the recall, the control of the recall process, the limitation of different time in recall and the stop and pause in recall.
