Research On The Removal Procedure Of The Deputies Of The National People's Congress

Recall is one of the most typical ways of self-relief, and the nature of the right to recall is a right of exchange. A citizen who has a right of removal may replace a representative of an elected or non-performing representative or a public official of the state without having to wait until the expiration of his or her term of office. We have formulated a series of laws and regulations to protect the voter's right to recall,to promote the democratic process, to protect the voters on behalf of the supervision.However, in recent years, the case of recalling the NPC deputies, reflecting the NPC deputies recall system in the specific operation still exists many problems,such as the request for dismissal is not clear; the examination and acceptance of the recall case and the absence of a special body for the review and acceptance of the recall case, and there is no clear time limit for the review; the right to plead on behalf of the petition was not adequately safeguarded and so on.This article attempts to sort out and study the relevant provisions and problems of the recall procedure in China, in order to improve the NPC deputies' removal procedure, this paper studies the four aspects of the withdrawal of the procedure, the examination and acceptance, the right of plea to be recalled, and the final decision of the recall. Specifically, it is necessary to make clear the request for the removal of the case; establishing of the removal of the NPC specialized agencies; the recall of the time to be limited; full protection of the right to recall the right to vote; the establishment of a practicable removal of the voting system.
