Analysis Of China-ASEAN Intellectual Property Dispute Settlement Mechanism

With the development of international trade between China and the ten ASEAN countries, more and more trade disputes happened. In the21st century, knowledge means wealth. In this circumstance, China must pay more attention to the problems which are based on intellectual property protection. With the assignment of Framework Agreement on China-ASEAN Comprehensive Economic Co-operation, the legal system between China and ASEAN builds up. China-ASEAN Dispute Settlement Mechanism Agreement is a successful pattern of settling the trade disputes which includes feasible ways and legal restriction. However, after I did some deep research, I found that most of these conflicts had been resolved by negotiating. Why China-ASEAN Dispute Settlement Mechanism Agreement has been neglected for so many yeas is the main topic of this paper.This thesis is composed of introduction, body and conclusion. Introduction represents the significance of the topic, research status and ideas. Mainly discussing on why I choose this topic and what the obstacle I faced, finally the structure is. Body is composed by five chapters. The first chapter includes the conception of China-ASEAN dispute settlement mechanism and the analysis of this conception. The second chapter analyzes the law of China-ASEAN intellectual property protection. In the third chapter, the author compares China-ASEAN dispute settlement mechanism with other two dispute settlement mechanisms and questions the systematic problem of China-ASEAN dispute settlement mechanism. In the forth chapter, the author lists the interior reasons, exterior reasons and the author’s own opinion. The fifth chapter lines some response measures and solutions of China’s own condition. The conclusion involves the author’s expectations of China-ASEAN dispute settlement mechanism.
