In recent years, with China’s economic level is rising, the credit card industry have experienced a trendof vigorous development, and China has become one of the most potential state in this field around theworld. Compared to the traditional payment instruments and credit vouchers, the credit card itself has thecharacteristics of electronic and virtual, in the event of disputes, credit card consumers tend to demandmore strong protection in law. This paper starts from the basic theoretical point of view to protect creditcard consumers’ interests, defined by the credit card consumer protection laws and explore the legal natureof the relationship between the parties by in the credit card, combined with foreign consumer protectionlegislation provisions on how to protect credit card consumers’ rights to demonstrate, in the hope to bebeneficial to the improvement of the legal protection system of China’s credit card and transaction riskcontrol.In addition to the introduction and conclusion, is divided into four parts:The first part is the basic theory of the credit card consumer protection. The part of the first legaldefinition of the credit card consumer; followed by the legal nature of the relationship between credit cardbetween the parties to explore and clear as a consumer credit card holders should be given specialprotection; again from an economic theory, sociology, legal theory on the three levels of the theoreticalbasis to protect credit card consumers’ rights to conduct feasibility studies, and in theory, strengthen theneed to investigate the credit card consumer protection.The second part deals with credit card consumer protection legislation at present within the scope ofworldwide, many countries have attached considerable importance to the protection of credit cardconsumers, credit consumption developed countries and regions, on the legislative level specificationattaches great importance to legislation on credit consumption in some countries and regions also speciallyformulated for consumer credit laws and regulations. This article intends to credit card consumer protectionlegislation documents in the relevant provisions of China’s existing laws on consumer protection and theUnited States and Britain, and China’s Taiwan region by comparative analysis, summed up the successfulexperience to draw on the credit card business practices, to improve our country credit Card consumer Protection legislation for reference.The third part is my suggestions on the establishment of the credit card consumer protection system. Inorder to effectively protect the legitimate rights and interests of our consumers, I believe that should beclear in the legislative process in the future of the case against the legitimate rights and interests ofconsumers to be provided to establish a complete set of consumer protection, consumers’ privacy the rightto know the real protection and realization, when the risk of liability arising from fraudulent risks, shouldthe issuing bank and cardholder a reasonable allocation.The fourth part is about to take on credit card consumer protection legislative proposals. First of all,the problems of China’s credit card legislation summary analysis of credit consumption successfulexperiences and practices based on the summary of the developed countries and regions, the ConsumerProtection proposed a specific set of legislative proposals, not only at the legislative level the idea that theinterests of consumers protection legislation improved, but also a nationwide credit card business todevelop a unified model contracts and legal norms on personal credit perfect regulation. In order tomaintain the legitimacy of China’s credit card consumers rights, access to timely and effective help whentheir legitimate rights and interests benefits have been infringed.
