Consumer credit is the inevitable product of China’s market economy develops to a certain stage, is an economic phenomenon that in order to seek a balance between production and consumption under the conditions of market economy developed. Credibility is a holy grail of all walks of life development. However, the idea of credit integration is the resources of consumption which built on trust in the global economy market, it makes the consumer without immediate payment to obtain funds, services, credit that seems to have become a form of capital operation. So far, China has yet to establish a legal system of protection and a system of scientific operation to adjust the social credit mechanism, which makes consumer credit obtain reasonable norms and constraints in the real life. The result of credit problem frequent and economic problems of Central Health highlights, thereby affecting the issue of national survival.With the deepening of China’s reform and opening up, the market economy is also facing profound changes. Consumer credit has also become an important part of China’s economic development, has made a huge contribution to the expansion of domestic demand. However, due to the lack of the legal system on consumer credit in China, making the consumer credit business such as violations of the legitimate rights and interests of consumers, and bank loans difficult to recover bad phenomenon, we must extent hindered the development of consumer credit. Consumer credit in the United States and other developed countries, the legal system has its own characteristics where we can learn from. We must strengthen the consumer credit legal construction, improve the consumer credit legislation to speed up the enactment of the Consumer Credit Act, This paper is divided into four main parts:The first part is a consumer credit Overview:First, consumer credit is defined following the analyze of consumer credit providers; through the generation of consumer credit in China, such as bank cards, individual housing loans and other consumer credit model generation and development to illustrate the characteristics and performance in the form of consumer credit in China.The second part is the comparison and reference with consumer credit legislation in developed countries. By foreign legislation governing consumer credit guarantees and risk prevention mechanisms, the system of protection of the interests of consumers, the personal credit system to analyze the characteristics of foreign consumer credit legislation, through the study of comparative law, and to provide a reference for our consumer credit legislation.The third part is the legislative status and existing problems in China’s consumer credit system. Overview of the legislative status quo of China’s consumer credit problems that exist in the legal system of China’s consumer credit:consumer credit legislation bit low class times; lack of effective risk prevention mechanism.The fourth part is to propose to establishment and improvement the Consumer Credit Act. Through the front of three parts, the basic idea of building the legal system of China’s consumer credit. First, put forward the proposal of the establishment of the Consumer Credit Act, expounded the necessity of the establishment of the Consumer Credit Act; perfect credit guarantees and risk prevention mechanisms to make recommendations to improve the consumer credit guarantee system, financial agency management organization system, consumer funds the way they operate; again, consumer protection, should the legislation implementing the moderately tilted protection principles, clear the fundamental rights of financial consumers and strengthen consumer credit information disclosure obligations, strengthen the construction of industry self-regulatory organization, a self-regulatory mechanism to further improve the financial consumer protection; last for the construction of personal credit information system, the clear the credit bureaus legal system should follow the principle of the development of an independent and efficient credit agency, to establish a sound credit investigation and evaluation mechanisms.
