| The beginning of Nation-building in this essay refers to the historic period from 1949 to 1956.In this period, the first leadership group was facing a key issue:what kind of leadership and governance to choose and form in order to strenthen the new political power and to ensure the process of revolution and construction of socialism.From the concept, this essay analizes the necessity and certainty of governance in accordance with law. Then it comes to the situation and background for CPC(Communist Party of China) to govern in accordance with law at the beginning of nation-building, introducing CPC’s early exploration during the democratic revolution period, the severe situation after getting the political power, and analysing the difficulties through revolution to get the political power.After that, this essay highlights the systemic exploration and practice of governance in accordance with law after CPC got the political power, including CPC and leaders’concept understanding of governance in accordance with law, the achievement on legal system constructions, the actual practice of governance in accordance with law, and so on. At the same time, it studies the subject and object causes of frustration during this period. The limitations are the misunderstanding of the change from "revolutionary party" to "governing party", the clear disadvantages of unifying leadship and governance, the terrible situation of "substituting one’s words for the law and abusing power to crush it", the stubborn mind of instrumental legal system, and so on.Finally, this essay gets experience and revelation from strenthening the governing position of CPC, changing from "rule of man " to "rule of law", the characteristics of "rule of law" in socialist construction, and properly handling the relationship between the party and the law, and the relationship between the party and the politics.Through the study and the analysis on governance in accordance with law of CPC at the beginning of nation-building, this essay has the conclusion:the concept of "governance in accordance with law" raised after the 16th Party Congress is the necessary demand of the situation, and even the certain choice of history. This is the best way of CPC to strenthen the power-holding position and to improve the power-holding ability. |
