| In recent years, the frequent occurrence of food safety incidents caused widespread concern of the international community. International trade of food carried out to promote the internationalization of the food production chain, which achieved the optimal allocation of resources, but also made it that food safety incidents in a country or region spread to neighboring countries and even the world. In order to protect the public health, WTO members apply technical measures to trade according to Agreement on Technical Barriers to Trade and Agreement On The Application of Sanitary And Phytosanitary Measures. Under the background of trade protectionism is rising after the economic crisis, food safety issues provide a good excuse. Some countries under the name of ensuring imported foods’safety and the necessary of national public health, which actually is a set of barriers to food safety. Such trade barriers hinder the development of trade in food, and make it easy to trigger trade frictions. As one of the largest trading nation in food, China faces difficulties as to the trade measures to protect food safety in exports subject, coupled with the adverse impact of the domestic food safety incidents. Therefore, for the security issues in the food trade, in-depth study about international trade law, adapting legal system of food safety in developed countries, regulate food safety barriers to trade would be a certain extent to solve the problems in China’s food export trade, therefore will get a certain practical significance.The article is divided into four main parts:Chapter One describes the influence caused by food safety conditions to international trade. It clears the concept of food and food safety, and then points out problems about the food safety barriers to trade. Chapter Two introduces the advanced security systems of law and technical barriers to Trade for food safety in the major developed countries that have highest food safety standards. It would be a good reference for any country a study about their experience. Chapter Three writes about the current international and domestic law regulation about trade barriers on food safety. First is a study about international rules and laws about regulations about trade barriers on food safety in developed countries and regions. Then the author points out the defects on those international rules and laws. Chapter Four considering the methods that can promote the legal system on food safety of China’s food trade. First is a study on China’s existing legal system on food safety. Then is an analysis about the problems in our country. At last the author attempts to make some suggestions in order to promote China’s food safety level, to break down food safety barriers to trade, and to make China’s food trade running smoothly. |
