Research On The Legal Regulation Of The Administrative Management Of The Collective Land Circulation:

Land is the most important production material and living goods for human being. The general purpose of the land system refom is to promote and protect the land transformation from solidified property to dynamic-use property. The collective land circulation reform is an important part of the land management reform of Binhai District. It’s related with the optimized allocation and the rational flow of the land resources and the process of the large scale operation and intensification of the collective land. It’s also related with the transformation of the rural labor force, the development of agricultural production and also the improvement of the living standard of the farmers. It is comprehensive and systematic project which can take one-change-makes-all-changes effect.It involves in land planning, confirmation of land right, approval of land before circulation, the settlement and guarantee of the farmers, the settlement of the circulation dispute and the performance evaluation of collective land circulation, etc.Collective land circulation is policy-leading circulation. The government plays an important part in policy-making, land planning, protecting the limited land and the farmers’ rights, supervising the circulation process and executing the plan and other multi-layered activities. The government is the subject of the management of collective land circulation, which plays an important part as the policy-maker, the explorer, the enforcer and also the supporter. In this paper, through combing the role of the central and local government who play in the collective land circulation of the Tianjin Binhai District and making combinations with the experiences from the legal regulations on land circulation, the author find out the problems of the collective land circulation management of the Tianjin Binhai District. Finally the author put forward the solving thoughts, hoping the collective land circulation reform in Tianjin Binhai District will be more nonnative and smooth.
