The Legal Issues Research About Rural Collective Construction Land Circulation Under The China’s New Urbanization Background

Urbanization is an important indicator about measuring a country’s industrialmodernization.And urbanization is the trend of human economic development socialcivilization and progress of times. It is also to accelerate the objective requirements ofcomprehensive well-off society. In recent years, the central government attaches greatimportance to the construction of new urbanization, and actively explore effective newurbanization development ways. New urbanization process on the one hand theperformance of population urbanization, urbanization, lifestyle and on the other handaffects the performance of land urbanization. Among them, the land is the basis ofurbanization coordinated development of urban and rural area, the most critical factorwhich is affecting the development of urbanization. Along with contradictory rapiddevelopment of China’s urbanization, the demand of urban construction land and landresources are scarce among the increasingly prominent. Reasonable transfer of ruralcollective construction land is not only able to effectively alleviate the problem, but alsoimprove the utilization of land, increasing farmers’ income, and offering the overalldevelopment of the rural economy has a positive help. But also in response to the eighthafter plenary meeting "people-centered" new town requirements. China’s rural collectiveconstruction land market has become a new trend. However, due to the lack of restraintand normative laws and regulations, most of the farmers’ interests can not be effectivelyprotected, and that resulted in a waste of land resources. In this situation, how to play anactive role in government and other related subjects, how to effectively promote thetransfer of rural collective construction land is an urgent need to focus on and solveproblems.Based on the introduction and the legal nature of rural collective construction landconcept analysis, leads to urbanization in the context of the necessity and feasibility ofrural collective construction land, and through the existing collective construction landtypes summarized, understand and tap the current process of urbanization of ruralcollective construction land problems and then make recommendations forimprovement of rural collective construction land-related regulations and policies.Study these issues, the main use of the literature and empirical research, firstly throughthe extensive literature research combing preliminary for the new urbanization of ruralcollective construction land and then have a deep understanding, and a clear directionand a breakthrough by this study. After that through empirical research on theexperience of the pilot areas and typical profiles summarize analyzed the advantagesand problems for the conclusions of this study provide a strong evidence. Althoughthere are a large number of articles in the past research significance of rural collectiveconstruction land, but did not put it under the new urbanization background research.This paper mainly associated with the new urbanization and rural collectiveconstruction land between the perspective of deep-level mining rural collectiveconstruction land and its significance from a legal perspective the urgent need to solvethe problem.
