In a society governed by law, conflicts often occur in experimentingthe law. One of these may be evident in the relationship between “law”and “Human Sentiment”. This paper argues the “human Sentiment” maycontain two aspects, personal and public.Using case study andcomparative review, the article discusses these two types of conflicts indetail and indicates that three primary areas may contribute to theseconflicts.They are: The inherent conflict within the traditionallyestablished social standards/laws versus the modern development in thelaw; The differences of the traditional and modern morale standards andsocial values; and The dilemma of maintaining the relationship and“mianzhi(saving faces) above the law. Finally, the paper proposes, byproperly balancing and integrating these conflicts, the society may seegreater transparency and justice exercising the law, thus help to neutralizethese potential conflicts. |
