With the trend of humanism of international law, the protection legislation of overseasChinese citizens’ rights should be improved. Our imperfect overall system interferes withthe carrying out of the measures of protecting overseas Chinese citizens. Based on people’svalue, the purpose of this research is to give advice on how to perfect our country’srelevant legislation and gradually perfect protection mechanism of overseas Chinesecitizens’ rights.Focus on protection of overseas Chinese citizens’ rights, my research content mainlyincludes three parts:The first chapter is to interpret the trend toward humanism of international law, definethe concept of overseas Chinese citizens and state transformation of overseas citizens innew situations with finding out its characteristics.Chapter two introduces the foreign fruitful system of overseas citizen protection,analyzes the characteristics of legislation and seeks for the place for reference to improveour overseas citizen protection system.As to the third part, through analyzing the current situation of China’s citizen overseassafety, the paper tries to found our country’s relevant legislation and system imperfect andthen put forward operable and specific suggestions.What makes this paper original lies in three aspects: Firstly, it riches the overseasChinese connotation; Secondly, the introduction to the protection system of overseascitizens in Japan, the U.S. and the EU emphasizes its most distinctive features so as tocorrespond with China’s national conditions; Finally but not the least, the paper putsforward some suggestions on the general mechanism of protection of China’s overseascitizens, not just limited to the relevant legislation.
