Research On The Development Of Consular Protection For Chinese Overseas Citizens

With the strengthening of our comprehensive national strength and economic strength, the number of Chinese citizens overseas has been increasing. From the reform and opening up to join the WTO, and then to the "one way along the way", the pace of China to go out to accelerate and deepen. But now the global security situation is complex,China wants to go out safely,in order to China's citizens safe walking in every corner of the world, we must speed up the development of consular protection. At this stage of the study of consular protection has begun to spread out,but this area is still in the country is still a relatively new area. Accelerating research on this issue will form a guarantee that China will become a global influential nation.First of all,this article begins with the study of the consular protection system,and explores the prerequisite for more precise definition of consular protection by exploring the historical development of the consular protection system, especially the definition of consular protection in international and international regimes. Next,through the study of the United States, Britain, China and other countries official text,the material mentioned in the relevant provisions on consular protection for the definition of consular protection concept to provide a broader axis. On the basis of the above research,combined with the inspiration from many scholars' perspectives and the personal thinking of the author, abstract the concept of consular protection.Secondly, from the perspective of historical research, this paper explores the three stages of the development of consular protection in China and the analysis of the causes of its development, and provides historical experience for further research on the influencing factors and development path of Chinese consular protection. From the beginning of the new China to 1978 is the Chinese overseas citizens consular protection from the gradual start to stalled stage. From 1978 reform and opening up to 2004, China's overseas citizens consular protection from the stagnation into the rapid development stage. This is mainly manifested in the signing of the consular protection treaty, the improvement of the domestic legal system, the integrity of consular institutions and so on. After 2004, the consular protection of Chinese overseas citizens entered a new stage of development. Thirdly, it discusses the problems and shortcomings of the development of consular protection in China at the present stage.The fourth chapter is the solution to the problems existing in the protection of consular protection in China, and the solutions to the consular protection of our country are put forward by referring to the methods and methods of consular protection and development.
