In recent years, with the development of the network, the global economy has brought great opportunities and vitality, but the legal issues related with this are endless. Especially, with the combination of the network technology and unfair competition, a series of continuous variations of new type of unfair competition in Internet are produced. They’re usually difficult to regulation, such as Cyber Squatting, Malicious Hyperlink, Embedded Meta tag, Malicious Software, Spam etc. These new form behaviors of unfair competition in Internet seriously interferes the order and hinders the healthy development of the network market. Consequently it is of great importance to strengthen the legal regulations about Internet unfair competition.This paper is divided into four parts:The first part discusses the meaning of unfair competition behaviors in Internet, and reveals the characteristics and manifestations of unfair competition in Internet.The second part reviews the main problems which exists in China’s regulations of unfair competition behavior in Internet, and also discusses the limitations of existing legal norms, such as the lack of laws and regulations, judicial obstacles and imperfect law enforcement system.The third part introduces advanced legislative experience in the United States, Germany and other developed countries, and gives some referenced proposals to improve the relevant legal system in China.The forth part is the core content of the dissertation. Through the second part analysis and the third part reference, in order to effectively regulate Internet unfair competition, the last part proposed specific countermeasures for regulating our country’s unfair competition behavior in Internet from three aspects of legislation, judicial and law enforcement.
